These general terms and conditions of sale govern the relationship for the sale of products and services between Fabrik Srl through its website FOCARINI BIKES (https://www.focarinibikes.com) and users or end customers.
By placing an order, the user declares to be aware of and accepts these general conditions, which are available to anyone on the Focarini Bikes website.

2) Buyer: an individual who purchases goods or services on the website.

 

Applicable Law

The sale of products through the website constitutes a distance contract governed by Chapter 1, Title III (Article 45 and following) of Legislative Decree of September 6, 2005, No. 206 (Consumer Code), and Legislative Decree of April 9, 2003, No. 70, which regulates electronic commerce.
The general terms and conditions of sale may be modified by the seller at their discretion, and their validity is linked to their publication. They will only be applicable to contracts entered into after the date of publication.

 

Purchases on the Website

Unless expressly agreed in writing, Fabrik Srl does not recognize the generality of the buyer.
Purchases are only allowed for users who have reached the age of 18.
The seller has the right to terminate the contract in the case of orders from a buyer with whom there is a legal dispute or in the case of abnormal orders in terms of the quantity of goods ordered.

 

Account Creation through Website Registration

The user can register for free on the website by creating their own account and will be responsible for all activities that occur on their account.
If registration occurs at the time of purchase, the user is required to provide their address, phone number, and tax code. The user guarantees that the information is true and releases the seller from any damage or compensation.

 

Products

All products offered on the website have a detailed and accurate description. This allows the buyer to make an informed decision when purchasing them.
Any photographic image, drawing, weight, measurement, color description on labels, present on the Focarini website or in promotional catalogs, are purely indicative and cannot lead to damage compensation or contract resolution.

 

Prices

The prices of products on the website are in euros, including VAT, and valid only for the Italian market.

Prices do not include shipping costs, which will be indicated in euros, including VAT, if applicable, in the order confirmation.
The seller reserves the right to modify prices at any time at their sole discretion.

 

Contract

The order sent by the user, if complete with all the essential elements to clearly identify it, including the place of delivery, is considered a contractual proposal and implies knowledge and full acceptance of the sales conditions. Upon receiving the order, the seller will send the user an order confirmation with all the required information, which must be signed and returned.
From that moment, the buyer no longer has the right to modify the order without the seller’s authorization.
If the seller does not receive payment within 10 working days from the date of the order confirmation, they have the right to terminate the contract.
The seller has the right to refuse an order if it is bound by specific requests.

 

Right of Withdrawal

The right of withdrawal is not applicable if Fabrik manufactures the product according to the technical specifications suggested by the buyer.

 

Product Availability

The products indicated in the catalog may be either immediately available or unavailable. The delivery date is specified in the order confirmation and is subject to timely payment as agreed upon. Availability is monitored daily, but there may still be occasional spikes in sales that result in items becoming out of stock. In such cases, the buyer will be provided with a new delivery date and can choose to either cancel or confirm the order.

In the latter case, the Buyer will be entitled to a full refund of the order using the same payment method.

Payment must be made within 10 days from the date of the order confirmation, and from that moment, the production of the order will commence to meet the specified delivery date in the confirmation.

 

Delivery Times and Method

Based on the delivery times stated in the order confirmation and upon regular payment (including shipping), the seller will assign a carrier to deliver the order to the specified address. The buyer will receive a notification and may receive a tracking link for their shipment.
The buyer is responsible for the final assembly, which involves handlebar rotation and pedal installation.
Upon request, we can provide a video tutorial with instructions. The buyer acknowledges that it is their precise obligation to accept the delivery, and no liability can be attributed to the seller for delays caused by the carrier or force majeure. The accompanying document describes the materials and packages delivered. The buyer must check that the materials correspond to what is stated in the document and that the packaging is intact and undamaged. Failure to make any written reservations on the transport document implies acceptance of the delivered order. The legal warranties for the delivered materials remain valid.
Ownership of the product or any part thereof is transferred to the buyer only when they physically take possession of the items by signing the transport document, to mitigate the risk of loss.

 

Invoicing

A regular invoice will be issued for each order and will be available in the customer’s account or billing section.
